Hello everyone,
Realmwalker wrote a comment on the last thread that was a nice summary of the latest, so I thought I would do a new post to highlight his points, with some minor updates/changes. Good work Realmwalker!
- Brian is in contact with at least one potential sponsor that will help with the game’s finances.
- Brian has contacted Verizon about the FiOS internet upgrade and I believe the upgrade has been ordered.
- D Man through the company he works for has come up with some really nice credit card rates for the CSFBL, which we are certain to take advantage of. We would like to thank D Man for all of his help (he also got at least one potential sponsor in contact with Brian), he really has gone above the call of duty.
- Last I knew, we are still working on picking up the server. Since only Brian among us lives in New York City where the server is, and since he works lots of hours with a good 2-3 hour commute each day, plus a family, it has proven difficult to arrange the pickup of the server from what will soon be our former ISP. Unfortunately this ISP is not in the easiest location to get to, else Brian would have already picked up the server. He is working on the arrangements though, be rest assured!
- Speaking of tonight, the community managers and developers are having a conference call tonight to get the latest updates on the situation, along with hashing out ideas for the credit system, and more.
- Finally, we are moving forward with the idea that the primary game itself is free, with a credit system that allows you to “purchase” add-ons for your franchise.
We will have more information for you either late tonight or first thing tomorrow morning, after we have our conference call tonight.

not out of impatience or anything but more to lessen the troubles of brian and that monster commute, i’m sure if it expediates the process people who have donated wouldn’t mind 50 or 100 bucks of the raised money being put towards having the server picked up. then again i’m not sure what a server is so if it’s the size of a refrigerator or something, never mind

Unless its ancient, it shouldn’t be any bigger than a normal computer. It seems like there will be alot more money being made for csfbl in the future, so man up, call in sick tomorrow, and go pick it up.

The one sponsor I was really wanting fell thru, I had interests from the National Baseball Hall of Fame…the last e-mail I received from them in which they gave their reasons for passing said alot of nice things about the game based on what info I provided them….but also said they have never promoted anything like CSFBL and did not see the Benefit in doing so…I am kind of bummed about that one, I was really wanting that sponsorship….But there is communication being made with 2 more possible sponsors…

I would appreciate anyone who has any leads to get those to the appropriate people thru e-mail and not post them here..that way if anyone has any intentions of crashing any prospective sponsors they have no idea who we are contacting…
I am not saying someone would actually do something like that…but the possibity is there based on recent events and we can keep the possibility from happening .

This whole “sponsorship” thing is a new idea we’re exploring. I am talking with chris, realm, harbor, and babarfloyd right now to figure out what our options are and what is feasible. The goal is to absorb all the operating costs we can while maintaining a consistent gaming experience that people have grown accustomed to.
Until we come up with final decisions, and you hear something official from me, Chris, Realm, harborpirate, or babarfloyd, there’s nothing more to say on the matter.

dman… i would urge you not to take everything so personally… and not get offended so easily…
I know everyone really appreciates what you have/are doing/done… and I hope something like brians statements wouldnt terribly offend you and make you stop doing your awesome work, because I dont believe that is how they were intended…
I think brian was trying to stop anything more from being said…
if you have 1 flaw dman… its that you are too passionate about CSFBL… and when something happens, you seem to make snap decisions based on your emotions rather than your logic… and i would urge you to (not just in this case) give yourself more time to analyze a situation before making some of your decisions… because your heart and effort is often in the right place… but it often only takes something very minor to set you off… and that is your 1 flaw…
*and you know that I appreciate everything you have done, and I am not trying to piss you off… just trying to get you to understand things as i (and im sure others) see them… so I hope you dont get offended by this

Also Bill, When I started doing what it was that I was doing I had 2 goals in mind, save CSFBL some money and try to keep the game free for everyone, I think I helped accomplish both, so my work would be done anyway and my goals accomplished….it was a fun ride and I did send Brian an e-mail thanking him for giving me the opportunity to help out.

Hey Brian and the rest of the planning group:
I word of warning regarding the kinds of credits that league and franchise owners are going to buy. If you recall, there was an issue regarding the use of player names in Yahoo Fantasy Sports involving both baseball and football players in 2005 because of player that was on a major league baseball or football team was considered as trademarked property. I think that this is something you guys might want to think about in terms of allowing team and franchise owners the right to be able to change player names because if they are able to do so, then the liklihood of utilizing professional athletes and their name-sakes are probable.
Something to think about since I have not seen anything posted about this and I am pretty sure that I did see that it would be great to change player names to their favorite players.

Brian checked into this once (I believe with a lawyer, since he used to work at a law firm) and basically as long as it is a user changing the player name and not Brian, then it is not an issue.
Same goes with team names.

Thanks Chris, I would still check into it since ComputerSims, LLC would gain financial benefits from users who would have the capability to change the name of players on their rosters over to name-sakes of professional athletes that are licensed property of MLB and their respective franchises (i.e the Boston Red Sox).
Also, since users would change player names, the burden would fall on the LLC to prove that their user was not changing a players’ name with the intent for its’ own entertainment benefit.
Saying that, if it ever became an issue and it then became public, that would only add to the public dissemination of the league as well.
Either way, it might be something that Brian should look into since I highly doubt that there has ever been a precedent like that before in terms of a computer sims league using the real names of major league baseball players that are under the protections of MLB licenses, which are legally protected by copyright and trademark.
If the game is going to go commercial by setting fees, then there are rules that the league, at the very least, should consider seeking legal advice from.

I make no statement either way as to whether or not “Red Sox Revisited” is right, but I’m pretty sure the naming and likeness rights of the MLB players (as MLB players, not as people) are controlled by the MLBPA, not MLB and the respective franchises. Again, just a sidenote.

Actually he could be right and it should be looked into, as long as there wasn’t any profit being made on the renames like in the past then no one really cares..but with donations now probably being the way to get renames then there could be a conflict..its definatly worth checking into…
I think as long as you use proper names…I.E. Gary Matthews and not “Sarge Matthews” your ok, that again is immulating but the Sarge destinction could be considered immitating.

I don’t think it’s an issue. By giving the opportunity to rename the player, I don’t think it falls into infringement. Think about Madden vs. joeschmo PS2 football game. Madden has the players names already imbedded and is sponsored by the player association. However, joeschmo game features randomly assigned names that can be changed to whatever and is not sponsored by the player assoication. i think so long as Brian is not creating MLB players and assigning them similar stat ratings, then it’s fine. There is precedent in just about every sports related game out there.
OOTP allows you to change the name to whatever you want and there is no players association endorsement or complaint.
I’m not a lawyer, but I think it’s a non-issue.

Not to beat a dead horse, but this issue is not about statistics, it is about the commercial use of name-sakes. Once commercial use comes into play in terms of being able to use another name that is protected by licensure, trademark and copyright protection, then you should make sure that your business is protected in allowing users to exercise their “freedom of expression” which in this case is by allowing franchise owners to be able to re-name players with fictional names to names that carry protections, against 3rd parties pursuing commercial gains regardless of statistical or rating implications that are utilized by CSFBL.

Actually that falls under immulating and not immitating BRH, Funny we are talkin about this, A buddy of mine was handed a lawsuit by Someone from Don’s guns in Indianapolis awhile back cause he ran a full page add where he dressed up like Don from Dons guns..but because he used Dons catch phrase “I don’t want to make any money folks…I just love to sell guns” my friend had to pull his add and settle the law suit, the judge wrote that if he hadn’t used the catch phrase then he would only have been immulating but because he used the phrase he was immitating.

Dman, I read it and it only discusses the free speech question regarding public figures. It does not answer the commercial question regarding the sale of credits in order to change fictional names for licensed products of MLB. That is why you are going to want to speak with someone about selling credits to franchise owners who could then re-name their players to someone that carries licensed protection by an incorporated body.

Alright, this got me curious so I called my Attorney for a little insight, of course if CSFBL feels its and issue that needs attention they will want to consult their own legal team.
Here is what I found out, immulating and immitating are 2 different things, CSFBL can post a disclaimer saying that all players in the game are based on a National Name data base, now that means I have my own problem in my HOF League, I have Catfish Hunter, Goose Goslin and Vida Blue, those can be considered immitations..If I change the Catfish to Jim and find the real names of Goose and Vida then they become immulations.
Thats the short explaination I received..CSFBL will need to go their own dirtection with it if they think it is an issue.

Crocko, as long as you are purchasing credits for any name that carries licensed protection like Brett Favre or Michael Jordan, then the LLC, that is selling those credits, may be found liable for allowing the franchise owner to change a player from a fictional name to a licensed-name unless there is some form of covenant that further limits the liability of the LLC from its’ participants. It would have to be a part of the term of service for each franchise owner that is paying for credits.

A credit will be spent to name the player, what you do with him after that is your choice, but you arent buying “renaming rights”, just the option to rename the player !

As an active trader, I look at re-naming a player as ultimately renaming a player in the league. More than likely, I’m looking to rename a studly prospect, but if I actively trade, I have to realize that my named guy may head elsewhere. That’s cool by me, still fun to have him in the league.

I think most rules will adopt a rule saying you cant change a guys name once he gets to the active roster, that will get very confusing if every day every player is changning names where as in LM it doesnt matter as much

You can’t copyright a name just like you can’t copyright a number. You think if Michael Jordan could have he would have copyrighted number 23. Now if it were Michael Jordan, Inc. than that you couldn’t use. If anyone ever played on smallball.com it’s been going for six years and not only players are named after MLB but teams also. There are hundreds of teams named NY Yankees or Boston Red Sox. They never seemed to have any legal issues.

Wasn’t there supposed to be an update yesterday with an estimated ETA? Also, if all these people in the NYC area are volunteering to pick up the server, why are they being ignored?
I don’t mean to be a jerk, I love the game and I don’t even mind paying for it, but I have a hard time understanding why nothing is happening here.

Brian is the one working on the arrangements to get the server picked up. His upgrade internet line at home should be going live on Friday. I imagine he would want the server by then, so he has the weekend to look at it and fix it.
I am not sure if he has contacted anyone who offered to pick it up, but if he needs to, he will.

On the UPDATE front:
As Chris has said, Brian is the guy who has the information, as soon as he has something other than “no real news” he will certainly update us all. The discussion we had Tuesday pretty much covered Brian’s new line upgrade (ETA: Friday) and then an arrangement to get the server, in truth with the CO-LO and his schedules it has to gel to make it happen (Rough ETA for Server pick up: This Weekend)
Sorry its not better news…but thats all I really have right now.

Keep in mind also, it is easy to offer to pick up the server, but the ISP might now allow someone other then Brian to come over (for security/liability reasons).

I just wanted to post this…not to be a negative person, I’ve been quite vocal on this blog in my support of CSFBL.
I am worried now about the state of the game. Its been, what, 11 or 12 days now…and technically, we are in the exact same place we were 12 days ago. All we have is a new place for brian to host the site…and have decided not to charge people. Thats great at all, but the server problems still exist, and we don’t even have the server yet to be fixed.
The reason I worry is I talk to alot of guys from different leagues…all private or premiere leagues. And I am starting to hear a ton of “I think I am done with this game.” Varying reasons: “inconsistencies,” “now that its been gone a few weeks, I realize how much more I can get done,” things along those lines. Its guys like these, the guys with families, kids, long houred jobs…these sort of “fringe” guys that give CSFBL its kick, that keeps leagues going.
I am NOT placing any of this on brian, or the CMs. I’m not actually placing it on anybody. I just think that it needs to be brought to attention that this extended downtime might STILL kill alot of leagues, more so than we thought, when the game comes back up. While some of us, myself included, will eagerly stay with the game, keep in mind that just as brian considers CSFBL a hobby…so do MANY of CSFBL’s users.
And while Chris is right that someone else might not be able to get the server…I think, perhaps, it is time that CSFBL seriously, seriously consider adding more volunteers to its staff. I am sure, somewhere in our users, there are people who can help brian with database maintenance, server issues, etc. Brian, your efforts over the years have been gargantuan, and are always appreciated. But I just think that maybe we should add a guy or two who can help if at all possible.

Another addition was JUST signed to the “Dont Sue Me” All STARS:
We really needed a SetUp man who could baffle the batters and get the ball to our Closer, WIDOWMAKER … therefore we just inked
GENGLISH, the Mad Man, to run setup!
The reason it took sooo long to sign this guy is that there were so many bizarre stipulation in his contract, most of them relating to OFF Field contingency plans….Oh well….welcome aboard:
